No, they're still in the right. The Freedom of Display the American Flag Act says they cannot prevent you from flying an American flag, but they can dictate how and when. They didn't ban the flag from being flown, they merely dictated it could not be flown during the Christmas season. They are well within the law.

The key is the determination of what constitutes a "reasonable restriction" and "substantial interest" under the law. I would argue that saying you can't just because it is Christmas would not qualify.

Maybe not, but who knows... The courts make odd decisions all the time. For instance, they gave HOA's permission to govern flags in the first place. There's no telling how they'll resolve a challenge like this.

WHY?
New and nice housing additions all have HOA because they help to keep the neighbor up!

Very simple. As others have stated, I don't need somebody else telling me how to maintain my property and what I can or cannot do. I maintain my property. It's not run down or neglected. We looked in neighborhoods with nice, and well maintained, homes and property. Those are probably inhabited by people of the same or similar mindset. We've been here almost 25 years. So far, so good.

I have determined that people who aspire to be on a HOA board are those who want to tell other people how to live and what they can have on property they purchased.

I have never understood why anyone buy in a HOA.
why would you want to live where some tells you what and what you can't do on your own property.
I guess some people just have a need to have a mommy and daddy of some kind to tell them no you can't. Geeeeeeeeeees

Property values. You have recourse when you neighbor’s grass is 2 feet tall, keeps a wrecked junker on blocks, or dumps all the waste from there house demo/remodel on the side of their house. The person across the street from me did all this.
