Good... it's nice to see some of these bogus claims taken to jury trial, instead of settling. Of course it's a gamble, as McDonald's found out a while back, but a win will keep more of this type of claim from being brought in the future.
I think the Mcy D's debacle pretty much caused all companies that sell coffee to put warnings on their cups(caution extremely hot etc). so they had minimal liability. If the barista had dropped the cup in his lap, he may have had some grounds here, but spilling a hot cup of liquid on yourself its your own damn fault. Want to avoid it....don't drink coffee.
