Both...Let's say the maximum posted speed limit on the 'I' is 70 mph, which I've always assumed means "IN ALL LANES" the absolute max is 70 mph.....period.
So say a fella is cruising along at 70 mph in the left lane (I'll admit to doing it sometimes) speed wise he'd be legal and in order to pass him (on the right ?) a person would actually have to break the law and accelerate over the posted speed limit of 70 mph to get past him.
So if a ticket was given would the guy in the left lane doing the posted 70 mph get the ticket for doing the correct speed but cruising in the left lane or would the fella that passed him going over 70 mph receive the ticket ?......or could both drivers legally be given a ticket ?
