Unfortunately the 13 th couldn't be applied to the states until 1868 with passage of the 14 th amendment



The 13th Amendment to the United States Constitution, passed by the Senate on April 8, 1864, by the House on January 31, 1865, and ratified on December 6, 1865, abolished slavery as a legal institution.

Abraham Lincoln was assassinated on April 14, 1865.

He wasn't too long dead.

The 14th amendment is the tool to incorporate but the scotus uses that that tool to selectively incorporate, based on challenges to various state laws that make it to the scotus and they decide if the constitution should be applied to the state and if so is the law unconstitutional and further they can apply it piece meal ie. Only part of the amendment they are wanting to apply.
So, yes then it must be applied.



and even then it had to be incorporated, right?
