Ok I have a question about this part you guys are arguing about. Say your behind on payments, and the bank sends out the repo guy. Your car is parked in plainview and you don't have a gate or fence closing off your property, so anyone can walk onto your property. So the repo guy is out there hooking up your minivan and you come out and exchange words. Repo guy isn't budging and home owner shoots and kills the repo guy. Home owner is gonna be in hotwater like Ersland correct? I mean the homeowner wasn't in fear for his life? He did exit the safety of his home and became the aggressor correct? The repo guy didn't break and enter, so its not burglary in the second degree. Doesn't the law say that he could and should remain in his home and call 911? I'm not 100% on the laws so I'm asking these questions because I'm curious. How would this play out in court? I know from a security guard pov you can't use deadly force unless you are arresting someone who has committed a violent felony which resulted in serious bodily injury or death.


Pretty much this. When the repo guy shows up, he will have the paper work in hand. At this point, the car belongs to the bank "by law". If the home owner comes out mad, you tell them to call the police. When the LEO shows up, you just hand him the paper work, verify the vin#, and the LEO is going to tell them to get their stuff out and go inside. Alot of times, if it is going to be hard to get, I would call the P.D. before I left and let them know where I was going and the vin# of the car. This way if someone seen you and called it in stolen, you are good. The LEOs will tell them that it is a repo. I have a friend who had been doing it about 15 years when he tought me.

First of all if you are on there property and you are stealing there car they have every right to pull a gun on you
and they will not go to jail you are a car thief when you are repoessing a car the only legal way to repo a car is
to take a county sheriff with a repo title and order form and let the sheriff handle it .
if you repo a car and get caught with it before you call it in the police after they turn it in stolen it is grand theft auto and you can go to jail . And with Oklahjoma law if they are on your property all you have to do is tell them they are
tresspassing and if they dont leave they can be arrested or worse !

You couldn't be further from the truth... You know, I read a lot of your posts and you are wrong with your information about 99% of the time... Maybe you should actually do some research before you put your random thoughts into text... Just FYI it isn't their property, technically it is the banks property until they pay it off... Hence the lien on the title... If they fail to fulfill your financial obligation with the lien holder, they can send someone out to reclaim THEIR property...

Well I tell you what if I ever get behind on my car payment I hope they send you
to repo my car because when I tell you to get off of my property and you don't leave
and I kick your ass or shoot you then we will see who is telling the truth !
we will see if the make my day law still holds up in court !

Don't be fooled if some tells you to get of off there property and you don't you are tresspassing and if you are tresspassing and stealing my car you are a thief as far as
I know .. And if the police come out they are going to make you leave because you are causing a disturbance !

And yes you can go on someone property but If the property owner tells you to leave you are tresspassing
you should probably leave because you will be tresspassing then I would say you could have your ass kicked or shot if you so like !!!


Repossession
If the debtor breaches the contract and is no longer able to make timely payments, the secured creditor may send a written notice to the debtor stating that it plans on repossessing the property. If the creditor is not able to get in contact with the debtor or if the debtor is not willing to cooperate, the creditor can locate the property and legally repossess it. See, statements like that are what show you for your true worth... Your line of thinking may send you to jail for a very long time... Then again, that might be best for society...

I worked for a note lot part time repossessing for about 6 months the typical buy here pay here place, kind of like Brian, we repossessed the same care 4 times he would come in pay his repo fee and catch his payments up then turn around and skip a payment again go find it because he would hide it and do the dance all over again. The money wasn't bad though the repo fee was $150 bucks and my deal was 50% of the fee for each car I took.

I took a ford fiesta one time that was 3 months behind, (most of this lots repo's were drive off's they kept a key till the note was paid in full), the owner heard me start the car at 3am in the morning(tweakers) and rushed out with a shotgun and blasted the rear of the car several times. I stopped at a pay phone to call it in and the cops already had the guy on the other line claiming someone stole "his" car, that was a royal mess then he tried claiming we damaged his car, the cops wound up busting him for manufacturing a couple of weeks later. That was the last one I did.

Yea, this is why I would call the police sometimes before I went out. Let the LEOs tell him where the car went. My buddy has installed some kind of box on his cars now. He can turn them off when they don't pay. When they pay, he turns it back on. Its like you said. They repo the same cars over and over. The pay was about the same as you made. I made more from the bank, but the buy here lots always have work.

All of the repo guys I have known have always stopped in at the local police station and gave them a heads up and showed the papers needed by the court and the creditor to get the property back. My uncle repo`od in CA for a few years.

Usually the cops won't get involved. They simply say it's a civil matter and handle it in court. At least that what we did at the Sheriff's Office.

BS cops will not get involved in a repo. Had a buddy was repo man, he called cops several times for help and they refused.
