Hey guys, long time no see. Ive been caught up with work and trying to buy a house, so things have been a bit hectic.

Question, I know a lot of you old salty dogs have served, and some of you have filed for disability. I am trying to get back on that train, as I have been saving sick and vacation leave for doctors appointments and getting this process done efficiently. I need some pointers though. I filed back in 2013ish for disability through the VA, scheduled my appointments to be evaluated, however, could not keep the appointments due to a job change, I wasn't going to miss 10 days of work the first month I started work. Just looks bad. I went to the Ebenefits page on the VA website and it seems to have my previous service related disability claim in the system, however, it wasnt finished, obviously. I can reopen it on the website and resubmit it, however would that be best? Or should I go o a DAV again or something similar and have someone go through it with me? I just want to put myself in the best possible boat, so that this can be taken care of without me getting screwed.

Any sort of pointers in this situation would be much appreciated.

Did you actually submit it, and just not show up for the appointments? If so, and you complete the appointments and are determined to have a level of disability, your original date of application will be used to compute back pay.

If you get (I think) 40% or higher,(might be 50%) you can apply for dependent pay if you have a spouse, and are eligible for travel pay to get back and forth to appointments.
Your prescriptions will mostly be taken care of, and you get one car tag a year from the Okla Veterans at a greatly reduced rate.

You can still go to a DAV officer to assist you getting back into the system. Just make sure you use your original application date.

It appears I still am in the system, however, all of my claims have shown up as "non service related". Due to my not showing up to the previous appointments. No spouse for me, cant find one to put up with my crap, lol.

I think I'm gonna try to get this most of the way done on the Website, and tomorrow after work I'll swing by a DAV or something and see what they say, just to get some clarification on the process. Then as long as nothing crazy happens, I can get it submitted tomorrow evening.

In the situation your describing take your info to the DAV officer. Be aware some are more proficient than others. I met a bad one the first visit, and got all of the mistakes corrected by the second.

My wife just wanted them to take care of her foot that the AF operated on years ago and kinda messed up. She ended up getting 10% disability, but still (3 years later) no operation. We didn't even care about disability, just getting her foot taken care of. The funny thing is, she can't draw a dime of the disability until the payments recoup everything the AF gave her to take an early out. She won't get any disability payments for 20 years! That was a joke. It makes me wonder if they take disability out of people's retirement? The early out money was basically in lieu of retirement. Sorry, don't mean to hijack...

It makes me wonder if they take disability out of people's retirement?

If you are below 50%, they do, under current "concurrent receipt" rules. My military retirement is reduced by the small rating I have. That small part comes separately from the VA. A coworker, who served less time than me and retired at a lower rank, ends up receiving more in retirement than me because he gamed his rating up over 50% so he could receive both.

I'm very opinionated about the VA disability system...which is full of fraud and abuse, and it tends to piss off a lot of "professional veterans" out there. I'll save it so as not to completely derail the thread lol.

PM me and I'll give you the info of a law firm that does those cases. We do a lot of SSD, but no VA claims. They take even longer than the normal disability cases, which is a shame.

In Dec. of 2014 I went through the 'Veterans Corner' in Norman for my initial claim and received my 70% disability rating in July of 2015 (three days short of seven months).

The 'Veterans Corner' is 100% free and is staffed two 1/2 days per week (1/2 day Tues. and 1/2 day Thurs.) by a great bunch of vet volunteers.

They are very knowledgeable on the filing of VA claims and they have all the forms that are needed to either start a new claim or reopen a older claim and even enlighten you about disability benefits that you may be entitled to claim on but are unaware of......."contact Dale Graham at 405-550-8806."

Also, the reduced car tags is only for vets rated at 70% or above, you are authorized two tags per calendar year and the cost is $6.50 each.......if you have more than two vehicles you pay the full amount on all above the two authorized.

Your wife knew she was getting a payment when she got out and she took it. If she wanted a monthly payment, then she should of taken that option. She cannot cry later, the VA system is not a welfare office.

I get the two reduced rate car tags I think they cost $25 at 50% disability.

My late FIL went to them and they were a great help to get him his benefits. My SIL went with him and praised them for all their help. News4 did a segment on their hard work of the volunteers. It took the gov awhile but finally got him his benefits. This was 3 yrs ago.
