i think if i could get my weapon drawn and pointed at the guy and ready to shoot, i would give him a verbal warning to put the gun down and lay on the ground. any sudden movement other than that i would shoot. but then again i have 2 boys and a wife and would not want to give the guy any chance in hell of shooting me, so maybe i would say nothing and shoot him in the leg, then if he doesnt drop the gun or tries anything from there, send one to the chest. i dont know, it seems easy for people to say what they would do when they are nice and calm sitting at the computer, but in that real life scenario things may go differently when the adrenaline starts flowin, so its hard to say for sure what exactly i would do.
If I were you I would change this post. I understand where you are coming from and I would shoot the guy myself but you need to understand what you just admitted to. You just admitted to using deadly force without thinking the situation warranted it. If you say you shot to eliminate the threat and felt like you were in mortal danger then in my eyes you are justified, if he died or was just wounded. If you say you just shot to wound him then you didn't think he needed to die but you still used deadly force, this will could land you in alot of trouble. If you admit to just shooting to wound and you hit an artery and it kills him, that makes it an accident right? And you just accidently killed someone you just wanted to hurt. Again I understand why you said it, but what you admit to and tell the police can and will get you in trouble. That's why alot of people say even if you are in the right you should keep your mouth shut after being involved in a self defense shooting so you don't say too much and say it in a wrong way that it gets used against you.

If I am a customer and I can exit the place without shooting I will. If he draws a bead on me, shots will be fired. As I mentioned to my wife when she asked me what I'd do the other day, I told her the only people I will protect is her, myself and any family member I know without a shadow of doubt is lawabiding (which pretty much means only my mom). Everyone else is responsible for their own safety.

There is never a cut and dried answer. Every scenario is different and we must each make that split second decision for ourselves. But here is what Title 21-1289.25 Section D says on the matter:

D. A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force, if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

yea true. and after thinking about it. i would be in fear of my life and would not want anything to happen to myself due to having a wife and 2 young boys, so i would just shoot and take him out and end the situation right there before any innocent people may get hurt.

In todays society if you wounded him he would probably sue you and win.

Section F of the same Statue addresses that issue:

F. A person who uses force, as permitted pursuant to the provisions of subsections B and D of this section, is justified in using such force and is immune from criminal prosecution and civil action for the use of such force. As used in this subsection, the term

Either I would shoot to stop the threat, or I would not shoot at all, but shooting on purpose to wound is not a good idea IMO.

It just takes a split second to pull the trigger, I would be afraid that the BG would be faster on the trigger and if I tried to give a verbal warning it would get me or someone else hurt or killed.

There is not an easy answer to these situations, I just pray that I am never in one, and if I am I make the right decision.

I thought stand your ground expired and we were under castle doctrine... but I'm not a rocket scientist on the differences. All I know is that to answer the original question. I've always been trained and of the belief that you never ever pull out a gun as a warning or advisement. It is a tool that you use for a specific and immediate need and as such, it gets pulled out, used and then put away. Period.

My mom and sister have both had the talk with me about possibly owning weapons, and the first question I'll ask is "Could you ever shoot someone?" When they paused and said "well....." I told them that I would discourage them from owning precisely because the hestation would get them killed. If you own be prepared to shoot, 2 in the chest, 1 in the head, then call 9-1-1.

My wife and I have had this discussion as well.. as, she CC's LEGALLY (just to clarify)..

Prior to her getting into comp shooting and practicing, my advice to her was to run for cover and cover yourself with your gun (defensive position preparing to shoot if the perp were to peep around the corner).. I too am not an advocate of warning shots or shooting to wound.. It leaves waaay too many avenues open for interpretation. If you pulled out your gun, you must have been scared, so act accordingly.

Now that she's got some practice in, and is a pretty darn good shot, we've revisited these scenarios..
But the final answer is the same, empty the mag.. Becuase you know that you were in fear of your life. (key words given to me by attorneys and LEO in Texas, Louisiana, and Oklahoma).

Personally, I have been in a couple of situations like that when I was younger, and I was seriously in fear of my life.. And returned fire.
Now that we're older and have been able to practice regularly and have kids and loved ones, it may be much easier to more calmly asses situations..

But you never know until your in it..
