The biggest problem I have with this is that those corrupt/incompetent folks in charge of things rarely get called out and replaced when this happens - so we all think "good, they learned their lesson" but in reality, the puppet-masters and those in charge do not. Someone had to have known this stuff was going on (the PD Chief, the mayor, City Council, etc...) as this isn't the first time this has occurred in NM. Those that did the action should be fired/prosecuted, but those who were behind it or allowed it should also be held accountable.

Kidnapping and rape charges all around. Big ole dose of prison time and sex offender registration. Perhaps they should get shived and gutted in prison

There is talk the police report states they have dealt with guy previously and him hiding drugs in his butt. This is the reason being given the warrant was issued in the first place.

Also, he was released after being ticketed, but as he walked away he was asked if they could search him and his truck. He told them they could search the truck, but not his person. Raising suspicion.

I have not read the report myself. Just heard rumors of the above.

It is the excuse the PD is using for why they asked for a warrant, I suppose. The slope is getting slippery. He said, she said, back and forth, but in the end...smelling marijuana is no reason to go this far. Its not a nuke. Geesh

Refusing to allow a search of one's person is not RAS. If he had already been ticketed and released, Terry Stop doesn't apply. And as I've said several times, after an x-ray and digital rectal exam revealed no evidence of contraband, everything performed after that is beyond the scope of qualified immunity and is in fact a criminal assault on the citizen. Everyone involved should be held to the higher standard of their oaths, and prosecuted criminally to the fullest extent of the law.

too bad the restitution will be paid by the victim and other taxpayers, rather than the sonsabitches that should be held accountable.

What's the big deal? It sounds like a typical TSA search to me.
