You know she decided to be the defender of Rights for the someone else and got arrested. She should of called the hospital administration and let them all figure it out. Even if she had drawn the blood, the legal system would have sorted it out as a violation anyway.
I think the LOE was a jerk that needed to learn his job, but if his supervisor told him to arrest her then he is not as much of a jerk.
I think the guy should have given her enough warning that she was going to be arrested, if she did not draw the blood.
Also, when she decided to stand her ground, I do not see why she got so upset when she was arrested.

Part of her job is to protect patients from harm while under her care.... and that includes respecting HIPAA laws.

She was on the phone with a supervisor (on speaker), who was telling the cop "you're making a big mistake". Do you seriously still have faith enough that our legal system would "sort it out"? The cop would get what he wanted, and walk away as the thin blue line circled the wagons and swept it all under the rug. Thank God for video, or this event would have been nothing more than a "misunderstanding".

I have faith the blood test would have been tossed out.

no one is internet lawyering, just saying she was doing her job, but that does not mean the cop was not going to arrest her. she got what she asked for.

Did you even watch the video(s)?

1) She was following hospital protocol to the letter
2) She was on a conference call with her bosses and THEIR bosses during all of the video that I saw.
3) She was only explaining hospital policy to the officers
4) She never tried to prevent them (physically) from doing a damn thing as far as drawing blood.
5) The police department had agreed to the policy.

So exactly what part of their actions is/are/were justified again?

Are you freaking serious? She did NOT ask to be unlawfully battered and detained against her will. What the officer did was a crime and "I was just following orders" is NOT a legal defense. It flat doesn't matter that the blood draw would be tossed as unlawfully obtained. She was 100% right and within her lawful rights. She defended an unconscious man from a criminal assault. The officer was 100% wrong and should've backed down. Far too many civil rights violations flow from "you will respect my authority" actions and that's exactly what happened here.

I can't believe I'm having to defend this wronged nurse on a rights centric forum. :disappoin

And she would have got the free ride downtown too.

Incredible that anyone who watched that video would respond like that. If she was asking for anything it was for the officer to realize that a policy was already in place, agreed upon and it probably didn't just happen that day with her printing it on hospital letterhead and showing him with her supervisor on the phone.

I am a very vocal supporter of our law enforcement but if he arrested a nurse like that I would question how he has arrested a violent criminal that deserves to be roughed up.

there not, but it does keep her from being arrested. the blood test same as her would have be tossed .

FB = Facebook so RIF... that means Reading is fundamental. Was just looking for input from someone who studies law, because uninformed morons are chiming in all over the place. However it might not be so different here, it seems.

In terms of "she got what she asked for" well that's one opinion. Most everyone else seems to find that she has the integrity to hold up the law and an actual agreement between the hospital and the police dept. You're a teacher yes? I hope you'd stick up for you kids in the same manner if you were on the right side of the law.
