Yes, if being done for law enforcement for someone in custody. EMT's can (and do, sometimes) do it on the side of the road.

If the commercial truck driver, who was burned and unconscious, has a CDL, does consent even need to be obtained to collect blood since the driver was on duty at the time of the collision? I had the impression the FMCSA regs stated no consent was required.
