So I thought you guys might like a heads up on a scam from way back in 2008 that my ex-wife pulled before our divorce was finalized and our joint checking was still open.


My ex-wife and I split in September of 2008 and were legally seperated in october. In November I had my name removed from our Arvest bank checking account and opened my own BOK account.

She had apparently either memorized my social security number or written it down either way it doesn't matter.

Wait I'm getting ahead of myself

Yesterday my brother gets a call from a collection agency trying to get a hold of me, he didn't answer but they left a message saying they were trying to serve me with a summons but did not have a current address. Thats quite weird seeing as I've been in my house since the beginning of 2009.

I called them today to see what was going on and the nice lady on the phone told me I was being sued for $1100 and change for a payday loan that original principal was $480. I had never heard of the place it's called Impact cash.com

What apparently happened was my ex used my name and social to get the maximum payday loan they payout into the checking account we had together, they never called me, and I never got an email the one they have on file is her email address and the phone number they had for me was her phone number way back then. So now I'm on the hook for $1100 bucks that I never even accrued as debt. I never even knew about the whole thing seeing as I had removed my name from the checking account and obviously couldn't and didn't check balances. The way the loan works is they pay the money into your account and then every other week they take $90 out of your account until the payday loan is paid off. She got the loan and immediately closed the account so they assumed I attempted to defraud them and have been trying to sue me ever since apparently.

So long story short I explained what I believe happened since I never applied for the loan and she is the only person who had access to the account anymore and it was blatantly her email address she used. They are settling with me for the amount of $240 bucks as long as I pay it before the end of the year. Merry mother****ing Christmas.

And she wonders why she hasn't seen the children since 2009. Obvsiouly I want my children to have morals...


So long story short fellers I should have closed the account handed her half the cash that was in the account so she couldn't use an old account statement with my name on it to get the money. If I had lifelock it would have caught it also but at the time I though her and I could still be civil with each other. I was wrong.

I know we have several members who are going through divorce right now please guys mind your P's and Q's I could have been screwed much worse than I was luckily I'm getting out for a lot less money but it could have been thousands.

Make sure you get a letter of guarantee that's states the payment is in full and the loan is paid off. Have it signed by them and keep it forever.

So I assume they can show you the papers with your signature on them??

Oh, of course not, that's what I thought. If they wanted you served, it would have happened by now.

They claim no signature was required. I'm not sure how to fight this without spending more than the 240

If you weren't a signatory on the account at the time the loan was made nor on the loan papers, I'd tell 'em F-off. You send them a written notice that you do not owe that debt and to cease contacting you. Send via certified mail.

But if you have told that lady that you agreed to any settlement or that you owed the money, then all bets are off.

Long time ago my opened several accounts with my SSN. Mine was 2yrs after the divorce was final and not one of the companies thought to check with me when a female opened accounts under my name and SSN. I could show that I never lived at that address and had my own accounts for my real address. I just refused to pay but it took years to get them to leave me alone and I had to have comments placed on my credit report stating that those debts were not mine. Eventually they were removed.

you might call or email Clark Howard about this, he helps people deal w/ this kind of stuff all the time and will likely be able to tell you the best course of action. $240 is cheaper than an attorney, but its way to much money to cover that businesses mistake. just my $0.02
