Her only legal action would be to draft Articles of Impeachment.


People need to remember that the Supreme Court is a separate but EQUAL branch of the government. I point this out because constitutionally, the Judicial Branch really doesn't have a dog in this fight. It should never see the inside of a court. It's inarguable that the Administrative Branch has broad powers to declare a national emergency. If the Legislative Branch considers such an alleged abuse of power to be unconstitutional, then they have the duty to draft Articles of Impeachment, after which the Senate must convict the President by a supermajority of votes (67 of 100 in this case). If they fail to do so, the President may continue to act within the powers vested in the Administrative Branch by the Constitution.

I realize that everyone assumes the Judicial Branch has the power to immediately nullify any decision the Administrative Branch makes, but it simply isn’t true. In specific cases such as this, he may simply ignore those Judicial Branch edicts and carry on. After all, he is the one who has authority over the people who could actually intervene. Until he’s impeached, tried and convicted, no one else can stop it.

I'm not happy with how this is playing out, but at this point I think it's time to cowboy the **** up, channel TR and Andrew Jackson, and get the job finished.

I read the OPs post and thought, oh that's a good point, maybe it wouldn't be good for Trump to use the emergency thing.

Then I read @tRidiot post and got all riled up and thought, hells ya let's do dis, make your play Poohlosi!
Agreed. Let the left attempt confiscation. I dare them.

who says they have to take the guns? How many people die from gunshots each year? Surely that could be an emergency. Simply going after the ammo and production methods would work just fine. Nothing says it has to be an 'immediate grab'.

Universal micro stamping would make your stash illegal, too. High cap bans, etc etc.

Not to mention that healthcare and climate could both become 'emergencies' under a Democrat president. "our obesity problems are starving our armed forces of needed bodies. We must act in the interest of national security and put our country on a diet."

It's just shocking how this became an 'emergency' once the GOP lost the house. Surely they'd have funded the wall before now if anyone could have foreseen this coming.

Let Pelnazi have her little fun and build the **** in increments. Has anyone seen the bill that is coming out? It specifically states the wall cannot be of the new construction that was decided upon, (which has the best chance of working properly).
