Other than that, what do you plan to do now that you didn't take the check?

It's a truck.

I sent claims a letter saying I agree they shouldn't have to pay for my scratched tailgate as it had previous scratches, but I want to be paid for an OEM bumper and my receiver hitch that was damaged.

That comes out to ~$500 less than the estimate I got, but ~$600 more than theirs. Seems more than fair to me.

What will I do? Wait and see what they spin. Not budge. See how long they want to deal with me over a few hundred bucks. I ain't hurtin' for cash or anything.

Like I say I personally know several turds who have faked injury in low-speed crashes and milked the payout teat. That's not me. I just want what is broken to be paid for in full. Hell... even close to full.

Kinda scummy of them if you ask me. The other guy was the one fawking around on his phone in traffic, not me.

After this and my last incident where I was lowballed on a total from SF (eventually getting 10 times what I would have initially settled for because they got scared of a lawyer coming in), in a crash with moderate damage or and a slightly higher speed...I will be going to the hospital and calling my attorney friend and doing whatever he says. Sometimes our litigious society is warranted because big interests don't seem to want to be square with the little man. Gross all around. Disheartening.

To expidite the process, you can file a small claims suit against the driver for the difference. This should get the ball rolling, because they will contact the insurance and demand them settle this claim. The only obligation the insurance company has is their fiduciary repsponsiblity to the policy holder, unlike some of the comments on here, the insurance company has NO obligation to you.

This is my next step if they don't compromise. I will give them a couple more chances first.

I figure they wil be quick with a check once their insured pitches a fit about getting sued.

I know most people who want the cash and not a repair are broke and wanting a free windfall, so they jump on that first offer and never make repairs. Probably what they think I'm doing. Nope. I will be making my own repairs and installing a custom bumper. And I don't need the cash. Much quicker and easier to make $600 at work than dealing with these clowns. I just feel I'm not being given a fair shake. I will gladly lose money to make them pay if I have to.

Wow great idea. Would not have thought of that. This by its self has made following the thread worth it.

Maybe people became sue happy in the first place because corporations and insurance companies are unfair dicks?

When I was in my bad wreck 10 years ago, my own agent told me outright I would not be fairly compensated for my totaled vehicle and that was a losing battle, and all but told me to make up for it I should claim other damages. I was blown away.

I initially felt wrong and guilty about doing that (even though I actually was injured) but now my only regret is not actually suing their asses. I will be going that route if it ever happens again.

*the only reason they eventually offered me a decent check for medical, wages, etc, etc, was because this wreck was absurd. Blown stop sign at full speed onto a divided highway, hit me, rolled me 5 times. Multiple witnesses, some who took photos. Cops were all on my side. I was the only party not to leave in a helicopter. Fawk insurance companies. And also people who can't drive worth a crap.

Fool I'm on the road constantly for work and have never had an at-fault accident. Hit by a senile old lady who blew a stop sign 10 years ago, and bumped by texters twice while slowed to a crawl or stopped in traffic.

I even had my hazards on as I slowed for this last cat! Only text and drive if you have skilllz. That's my rule.

Also, just got assigned a "specialist" instead of a team of random claims folks. I was told to expect a response in 1-2 days. Bring it, fools.

If you loan me a a Glock, and I melt it, would you accept payment for a Hi-Point? Get outta here SF.

They are obligated to pay you, you ARE NOT obligated to fix your car unless the bank has a lien on it. You can take the check and spend it on hors and blow if you want. I got paid for 2 different hail storm damage claims to my truck, I didnt fix it the first time, just banked the $4400 with intention of fixing it one day, then 2 years later, another hailstorm that got my truck and roof on the house. They never asked if I fixed the truck the first time but I would have told the truth had they asked. So another check but oddly it was only $3800 lol... I didnt argu that though. Got it fixed a month later for $4000. Some new sheet metal parts, some bondo on the top and 100% new paint job.


Please say that this isn't true....
