The whistleblowers say the rule is being drafted by Senior Policy Counsel Eric Epstein, who worked as the Phoenix Field Office's Division Counsel during Operation Wide Received (a precursor of Operation Fast and Furious).
Such a sweeping rule with the effect of banning private sales would clearly violate the Second Amendment to the United States Constitution, which declares that “the right of the people to keep and bear Arms, shall not be infringed.”

Not sure if true but a FOIA request has been filed seeking more info…allegedly they’re drafting a 1300 page document to justify an ATF regulation outlawing all private (no background check) sales in the United States

If the gun is purchased within the state one resides, then the federal gov’t has no authority as it is a state matter.

If the gun is shipped or transported between states, then the federal can have authority over the transaction.
Absolutely, but that's not how they see it. Therein lies the rub. :(

They have zero authority over it. 2A reads as it is. Unless there is fine print that says they have the right to regulate?
When the government makes unjust laws explicitly towards the constitution it’s up to us citizens to stop it via talk, vote or violence.
This goes for anything that the government does. Example taxes. The only reason we pay so damn much is because we had citizens allow them to get away with it.

Fine arguments for a courtroom, Reality is they'll interpret law, throw your ass in jail and you can stay there until they sort it out, or you decide seeing your wife and kids is more important than the stand you're making. Take a plea, they win, you pay.

That's only if they can find that "one bad apple" to enforce their wishes.
