If I had to bet, this will go to the Supreme Court. The ATF does not care if they lose … they will monetize the loss by selling it as an example of the radical right wing nuts on the Court.

I'm a little doubtful they will. This would seriously strip power from the feds and the Scrotus seems to shy away from biting the hand that feeds them.

I'm with you, but if they do that, doesn't it default back to the most recent decision and that strips their power too? Granted the SCOTUS wouldn't be responsible but still.....

Yes - and the result would likely be other cases in other districts taking up similar cases yet returning different rulings. I'm far from being a lawyer, but that's my guess.

Keeping the ATF "rules" vague and confusing isn't an accident.

Sadly, since we don’t live in Texas, Mississippi, or Alabama, this really doesn’t matter too much unless the Supreme Court rules on it or our district does.
