Like I said, he needs to get punished, but if he is labeled a child pornographer, it will ruin his life. Apologies can me be made to other kid, it can be made up to them (it's not easy, but it can be done). I just don't like the idea of turning this into a sexual thing when it wasn't. You can get branded as a sex offender for taking a piss on the side of the road, there need to be limits on that stuff. Child porn is seriosuly stretching the limits of reason here. Make him do 100 hours com serv at a home for the disabled, he will learn his lesson. It should be life changing for this young person, but in a positive manner, not a negative one. Being labeled a child pornographer will guarantee this guy will never be able to get a good job, own a house, or be a productive member of society. It is a knee jerk reaction and it too much. Punshed him, yes, what he did was wrong, but child porn?

Personally, I think 10 lashes with a cane and 100 hours com serv with handicapped individuals would do him some real good. Maybe he will learn what life for those less fortunate is like and he will appreciate things around him a little more.

Im just so glad we didnt have cell phones, camaras and texting when i was in high school. Maybe the DA will be reasonable, a stiff fine paid to the victim and months of community service. Plus a good ass busting by the parents.

If the kid's crime is cruelty, don't label him a pervert. That's not doing anyone any good.

Make him spend 100 hours of service helping with special needs families or old timer homes. If he's a good kid, he will see the error of his ways on this issue, and 'sin no more.'

So where's the line? What WOULD it take for him to be charged with using a computer during the commission of a crime, or child pornography?

If a person had a large collection of images of kids in the toilet, would you charge them with child porn?

I seriously doubt community service at a facility for the disabled would do anything for someone like this. In my mind, that would be like having Jerry Sandusky take calls at a rape crisis line.

Mr. Devito shouldn't look so smug. The one thing this individual missed was that he's 18 and the age of majority, he's an adult. As an adult irregardless if you're still in high school you're subject to punishments commensurate with what an adult would be charged with.

The fact he's being held without bond, oh well. I wonder how some of you would be reacting if your child was the one who's the victim in this situation. What if the victim were younger (ie. 10-12) or a female or Mr. Devito was 19 -20 years old. Child pornography is child pornography, it's like say "you can't be a little pregnant".

A. Rape is an act of sexual intercourse involving vaginal or anal penetration accomplished with a male or female who is not the spouse of the perpetrator and who may be of the same or the opposite sex as the perpetrator under any of the following circumstances:

1. Where the victim is under sixteen (16) years of age;

2. Where the victim is incapable through mental illness or any other unsoundness of mind, whether temporary or permanent, of giving legal consent;

3. Where force or violence is used or threatened, accompanied by apparent power of execution to the victim or to another person;

4. Where the victim is intoxicated by a narcotic or anesthetic agent, administered by or with the privity of the accused as a means of forcing the victim to submit;

5. Where the victim is at the time unconscious of the nature of the act and this fact is known to the accused;

6. Where the victim submits to sexual intercourse under the belief that the person committing the act is a spouse, and this belief is induced by artifice, pretense, or concealment practiced by the accused or by the accused in collusion with the spouse with intent to induce that belief. In all cases of collusion between the accused and the spouse to accomplish such act, both the spouse and the accused, upon conviction, shall be deemed guilty of rape;

7. Where the victim is under the legal custody or supervision of a state agency, a federal agency, a county, a municipality or a political subdivision and engages in sexual intercourse with a state, federal, county, municipal or political subdivision employee or an employee of a contractor of the state, the federal government, a county, a municipality or a political subdivision that exercises authority over the victim; or

8. Where the victim is at least sixteen (16) years of age and is less than twenty (20) years of age and is a student, or under the legal custody or supervision of any public or private elementary or secondary school, junior high or high school, or public vocational school, and engages in sexual intercourse with a person who is eighteen (18) years of age or older and is an employee of the same school system.

Educators and teachers are looked upon as individuals of authority. When a teacher/educator takes advantage of that authority and engages in sexual misconduct then it's a crime even if the victim is between the age of 18 - 20.
